Please read these terms carefully. They explain what Mixed Bag Sportsmanis, what we do and don't promise, and the rules for using the site.

By accessing or using the Mixed Bag Sportsman website, subscribing to our deal alerts or magazine, or clicking through one of our deal links, you agree to these Terms of Service. If you do not agree, please do not use the site. These terms apply to all visitors and users.

2. What Mixed Bag Sportsman is

Mixed Bag Sportsman is a promotion and listing service. We surface last-minute, discounted open seats on fishing charters and publish an outdoors magazine. We are not a charter operator, travel agency, or guide service. The fishing trips advertised on our site are offered, operated, and fulfilled by independent third-party charter operators.

When you book a trip, the actual booking and the contract for that trip are between you and the independent charter operator — not with us. Their booking terms, cancellation policies, safety rules, and conditions apply to your trip. We encourage you to review the operator's terms before you book.

3. No guarantee of availability, weather, or catch

Fishing is fishing, and the ocean does what it wants. We do not guarantee that any listed deal will remain available, that a trip will depart, that weather or sea conditions will cooperate, or that you will catch anything. Operators may cancel, reschedule, or modify trips for weather, safety, mechanical, or other reasons. Any such decisions are made by the operator.

4. Pricing and availability

Prices, discounts, seat counts, and availability are set by the charter operators and are subject to change without notice. Last-minute deals can sell out quickly. We work to keep listings accurate and current, but the operator's price and availability at the time of booking are what govern your purchase.

5. Affiliate relationship

When you book through certain deal links or coupon codes on our site, we may earn a commission from the operator. This never increases your price. Full details are in our affiliate disclosure.

6. Magazine subscriptions

The Mixed Bag Sportsmandigital magazine is offered as a paid subscription delivered digitally. You'll be billed on the cadence of the plan you choose (for example, monthly, semi-annually, or annually), and subscriptions may renew automatically according to the plan terms presented at sign-up. You can manage or cancel your subscription as described at checkout or by contacting us. Because content is delivered digitally, refunds are handled per the terms shown at purchase.

7. Acceptable use

You agree to use the site lawfully and not to: misuse or attempt to disrupt the site or its systems; submit false, misleading, or fraudulent information (including fake deal submissions); scrape, copy, or republish our content without permission; or use the site to harass others or violate any law. We may suspend or block access for conduct that violates these terms.

8. Fishing licenses and your responsibilities

You are responsible for complying with all applicable laws and regulations when you fish, including holding a valid California fishing license where one is required. Always confirm current requirements with the California Department of Fish and Wildlife (CDFW) and with your charter operator before your trip.

9. Disclaimer of warranties

The site and its content are provided "as is" and "as available," without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties, including those of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be error-free, uninterrupted, or that information is complete or current at all times.

10. Limitation of liability

In plain terms: because your trip is provided by an independent operator, we are not responsible for the trips themselves. To the fullest extent permitted by law, Mixed Bag Sportsmanis not liable for any indirect, incidental, special, or consequential damages, or for any loss, injury, cancellation, or dispute arising from a charter trip, an operator's actions, or your use of the site. Your dealings with any operator are solely between you and that operator.

11. Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any disputes relating to these terms or the site will be subject to the jurisdiction of the courts located in California.

12. Changes to these terms

We may update these terms from time to time. When we do, we'll revise the effective date above. Your continued use of the site after changes take effect means you accept the updated terms.
